Weiterentwicklung des P-Kontos durch das Pfändungsschutzkonto-Fortentwicklungsgesetz
Mit dem Pfändungsschutzkonto-Fortentwicklungsgesetz vom 22. November 2020 (BGBl. I S. 2466), das weitgehend am 1. Dezember 2021 in Kraft getreten ist, wird das P-Konto weiterentwickelt. Für Schuldnerinnen und Schuldner werden zahlreiche Verbesserungen eingeführt. Zudem wird die Handhabbarkeit der Vorschriften für den Kontopfändungsschutz optimiert.
Was hat sich durch das Gesetz geändert?
Das Pfändungsschutzkonto-Fortentwicklungsgesetz bringt unter anderem folgende Änderungen gegenüber der bisherigen Rechtslage:
- Erweiterung der Liste der Geldleistungen, die zu einer Erhöhung des Grundfreibetrages führen (vgl. Frage/Antwort Nummer 1)
- Erleichterung des Zugangs zu Nachweisen für die Erhöhung des Grundfreibetrags (vgl. Frage/Antwort Nummern 3 und 4)
- Verlängerung der Frist, in der nicht verbrauchtes pfändungsfreies Guthaben übertragen werden kann, von einem Monat auf drei Monate (vgl. Frage/Antwort Nummer 12)
- Normierung eines Verbots der Aufrechnung und Verrechnung bei Zahlungskonten mit negativem Saldo (vgl. Frage/Antwort Nummer 14)
- Einführung von Pfändungsschutz bei der Nachzahlung von Leistungen wie etwa Arbeitseinkommen und Sozialleistungen (vgl. Frage/Antwort Nummer 5)
- Schaffung von Pfändungsschutz bei Pfändung des Guthabens auf einem Gemeinschaftskonto (vgl. Frage/Antwort Nummer 7)
Verkürzung der Restschuldbefreiung auf drei Jahre
Am 17.12.2020 hat der Deutsche Bundestag außerdem das Gesetz zur weiteren Verkürzung des Restschuldbefreiungsverfahrens auf drei Jahre beschlossen. Das Gesetz soll rückwirkend ab dem 01.10.2020 gelten. Für Anträge, die vor diesem Datum (seit dem 17.12.2019) eingereicht wurden, gilt eine sukzessive Verkürzung.
