Gesetz zur Verkürzung des Restschuldbefreiungsverfahrens
Der Deutsche Bundestag hat am 01.07.2020 das Gesetz zur weiteren Verkürzung des Restschuldbefreiungsverfahrens auf den Weg gebracht.
Mit dieser gesetzlichen Änderung wurde ein wichtiger Schritt unternommen, um überschuldeten Menschen schneller einen wirtschaftlichen Neuanfang zu ermöglichen.
Verkürzung der Verfahrensdauer auf drei Jahre
Kernpunkt des Gesetzes ist die deutliche Verkürzung der Laufzeit des Restschuldbefreiungsverfahrens:
- Die Dauer des Verfahrens wurde von bisher bis zu sechs Jahren auf drei Jahre reduziert
- Nach Ablauf dieser drei Jahre kann die Restschuldbefreiung erteilt werden
- Schuldnerinnen und Schuldner erhalten damit deutlich früher Planungssicherheit
Bedeutung für Betroffene
Die Verkürzung des Restschuldbefreiungsverfahrens bedeutet für Betroffene:
- ✔ schnellere Entschuldung
- ✔ frühere wirtschaftliche Stabilität
- ✔ bessere Chancen auf einen finanziellen Neustart
- ✔ mehr Perspektive für die Zukunft
Gerade in Verbindung mit den Verbesserungen rund um das Pfändungsschutzkonto (P-Konto) stellt diese Gesetzesänderung einen wichtigen Baustein im modernen Schuldner- und Insolvenzrecht dar.
Fazit
Mit dem Gesetz zur Verkürzung des Restschuldbefreiungsverfahrens hat der Gesetzgeber die Rahmenbedingungen für überschuldete Menschen spürbar verbessert.
Die Dauer von nur noch drei Jahren schafft neue Perspektiven und ermöglicht einen schnelleren Weg zurück in ein schuldenfreies Leben.
